OVERVIEW

This website is operated by Leelapod. We offer livestream and on-demand classes, workshops and trainings (our Services). By using this website you agree to be bound by our terms and conditions of service (the Agreement). If you do not accept the provisions of the Agreement, you should leave the website and discontinue your use of our Services immediately. Our Services are not directed to persons under eighteen (18) years of age. You affirm that you are at least 18 years of age, and are fully able and competent to enter into this Agreement and to abide by and comply with its terms.

Leelapod reserves the right to amend the Agreement at any time and without notice, and it is your responsibility to review the Agreement for any changes. Your use of the website and our Services following any amendment of this Agreement will signify your assent to and acceptance of its revised terms.

REGISTRATION REQUIREMENTS AND DATA

To access our website and use our Services you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Canada or other applicable jurisdiction. You also agree to provide true, accurate and complete information about yourself (Registration Data) and agree to update your Registration Data to keep it true, accurate, current and complete. If you provide information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Leelapod reserves the right to suspend or terminate your account and refuse any and all current or future use of our Services

PERSONAL USE ONLY

Our Services are provided for your personal use only. Our livestream links, class recordings, workshop materials and training materials (Content) may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of Leelapod.

HEALTH DISCLAIMER

All forms of physical exercise carry the risk of injury. You are urged and advised to seek the advice of your doctor before undertaking any physical exercise. Leelapod and the instructors featured on the website are not providers of medical advice and none of the Services should be construed as containing any form of medical advice. Leelapod assumes that by participating in our Services, you take full responsibility for your own health and will not exceed your personal limits. You expressly waive and release any claim that you may have for injury of any kind against Leelapod and any person or entity involved with Leelapod, including its directors, principles, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.

LIVESTREAM SERVICE

Each livestream registration is provided for a single user, with the caveat that you may have a member or members of your household join you for a class so long as they are viewing the Content on your device. Link sharing for livestream classes is prohibited.

When you livestream Leelapod Content (Livestream), the video and audio quality of the Livestream you receive will depend on a number of factors, many of which are not within our control, including: your bandwidth, the type of device you are using, and issues originating with your internet provider or our video conferencing provider. We make no guarantee as to the quality of the Livestream you receive.

We do not send out links to class recordings. Payment for a Livestream class does not include access to a class recording as part of our Classes on Demand service. 

If you miss a class for compassionate reasons, please send a written request directed to hello@leelapod.com within 5 business days of the missed class and we may exercise our discretion to offer you a coupon code for a free Livestream class with the same instructor.

CLASSES ON DEMAND

When you subscribe to our classes on demand service (Classes on Demand) you will be required to choose a password, and you may be asked for additional information regarding your account, such as your e-mail address. You are responsible for keeping your password and account information confidential, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify Leelapod of any unauthorized use of your password or account or any other breach of security.

Content may be added and removed from our Classes on Demand service at our sole discretion. 

LIVESTREAM PAYMENT AND REFUND POLICY

Payments for Livestream classes are non-refundable. Should a Livestream class be cancelled by Leelapod and/or your instructor, or cancelled due to technical difficulties originating on our end with our service providers, we will issue you a coupon code for a free Livestream class with the same instructor. If you do not receive a coupon code within 24 hours of the cancelled class, please contact us at hello@leelapod.com.

CLASSES ON DEMAND PAYMENT AND REFUND POLICY

Monthly and Annual subscriptions to our Classes on Demand service automatically renew until you cancel your subscription. Monthly and Annual subscribers may cancel their subscriptions at any time via the My Account link on our website. Subscriptions must be canceled prior to the renewal date in order to avoid additional charges. If you cancel before your renewal date you can continue to access Classes on Demand until your renewal date. You will not receive a refund for the current billing period.

When you purchase a subscription, you will be charged at the rate applicable at the time of your agreement to subscribe. If you cancel your subscription, then opt to subscribe again, you will be charged at the rate applicable at the time of your new agreement to subscribe. 

CONTENT 

Leelapod may not pre-screen all of the Content posted by instructors. We are not responsible for the behavior of instructors and/or students and/or music on our Services. We have the right to edit, refuse, or remove any Content or portion thereof that is provided as part of our Services. We have the right to remove any Content that violates this Agreement or is otherwise deemed objectionable by us. 

If you become aware of any offensive Content, please contact us immediately.

Our website and Services, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements (Material) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by us or by third parties that have licensed or otherwise provided their material to Leelapod. You acknowledge and agree that all Materials are made available to you for limited, non-commercial, personal use only. You may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or to utilize our Services or any part of the Material for any purpose other than its intended purposes is strictly prohibited.

TERMINATION OF SUBSCRIPTION AND SERVICE REFUSAL

We require all instructors, staff, independent contractors, subscribers and users of our Services to comply with all applicable laws and to treat one another with decency and respect. If Leelapod determines in its sole discretion that you are violating any of the terms of this Agreement, we may refuse service and block or restrict your access or use of our Services. If we terminate your subscription due to a violation of this Agreement, you will not be eligible for any credit, refund or discount or other consideration.

LIMITATION ON LIABILITY

In no event shall Leelapod, its owners, officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (I) errors, mistakes, or inaccuracies of content, (II) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Service, (III) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (IV) any interruption or cessation of transmission to or from the Service, (V) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through the Service by any third party, and/or (VI) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Service, whether based on warranty, contract, tort, or any other legal theory, and whether or not the Leelapod is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

You specifically acknowledge that Leelapod shall not be liable for Content posted by instructors, subscribers or users, or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

Any reference to a person, entity, product, or service on the Service does not constitute an endorsement or recommendation by Leelapod or any of its employees. We are not responsible for any third party Content on the Service or third party web page accessed from the Service, nor does Leelapod warrant the accuracy of any information contained in a third party website or its fitness for any particular purpose.

No communication of any kind between you and Leelapod or a representative shall constitute a waiver of any limitations of liability hereunder or create any additional warranty not expressly stated in the terms of use.
